Anthropic Faces U.S. Ban Scrutiny Amid $15B Funding

Banks led by Morgan Stanley (MS) are in talks to arrange $15 billion of debt financing for a Nexus Data Centers project in Hubbard, Texas, that is tied to Anthropic PBC. The financing structure under discussion consists of a $14 billion bridge loan and an additional revolving credit facility for the project.

Alphabet Inc.’s Google is involved in supporting the financing package for the Texas data-center development. As part of the arrangement, Google would obtain an equity stake of about 20% in the project, which is focused on data-center and power infrastructure.

The Hubbard, Texas project is positioned as a large-scale data-center campus, and the size of the contemplated debt package reflects the capital-intensive nature of such infrastructure. The involvement of a major technology company alongside a bank consortium underlines the scale of the undertaking.

Under the contemplated deal structure, Google’s support for the debt package would be paired with an equity interest in the Nexus Data Centers project. The reported stake of about 20% would give Google a significant minority position in the data-center and power development.

The combination of substantial bridge financing and a revolving credit facility is intended to provide both upfront funding and ongoing liquidity for the Texas campus. This framework indicates a long-term capital commitment around infrastructure that is associated with Anthropic’s technology needs.

While detailed commercial terms have not been disclosed, the talks underscore growing financial backing around projects linked to Anthropic’s operations. The financing would be among the larger recent debt arrangements for a single data-center initiative.

In a separate development, a U.S. District Judge has voiced doubt that the administration has sufficiently justified its decision to bar federal agencies from using Anthropic’s AI. The ban is based on designating Anthropic as a threat to the government’s supply chain.

The judge stated that the government had not presented enough evidence “really justifying” the restriction on Anthropic’s technology. She described the argument that Anthropic’s public criticism of the Department of Defense could support the ban as “really troubling.”

The judge warned that accepting such an argument could set a precedent affecting other federal contractors who publicly disagree with government agencies. She indicated concern that this approach might be used to penalize companies over their public positions.

During the hearing, the judge also addressed claims that Anthropic could alter its AI model after delivery to federal customers. She said she did not see evidence that Anthropic had the ability to change the model once delivered or to “flip some kind of kill switch.”

The judge’s comments place the focus on the factual basis for classifying Anthropic as a supply-chain threat, including both technical and non-technical allegations. Her remarks suggest that the evidentiary record for the ban will be closely examined as the case proceeds.

Taken together, the scrutiny of the ban and the ongoing financing talks illustrate the contrasting pressures around Anthropic’s business environment: legal challenges over access to federal contracts alongside large-scale private infrastructure commitments tied to its technology.
