Taiwanese prosecutors on August 24, 2026 charged nine people over the alleged illegal export of high-end artificial intelligence servers to mainland China. The group includes one employee of Nvidia (NVDA) and two former employees of Super Micro (SMCI). Prosecutors state that the servers involved contained Nvidia B300 GPUs, a model that is barred from sale to China under existing export restrictions on advanced AI accelerators.

Authorities say the case centers on efforts to circumvent these restrictions by obscuring the real destinations and end users of the equipment. The charges reflect a focus by Taiwanese law enforcement on schemes that attempt to move cutting-edge AI computing hardware to the Chinese market despite regulatory controls.

Details of the alleged shipments and routes

Prosecutors say a total of 74 servers were successfully shipped to customers in mainland China. Of these, 50 units were transshipped via Indonesia, 16 were delivered directly to China, and eight were routed through Japan and then Hong Kong before reaching the mainland. These multiple pathways are alleged to have been used to disguise the ultimate destination of the hardware.

In addition to the completed shipments, Taiwan customs intercepted a further 56 servers, which remain in Taiwan. The combined figures indicate that 130 high-end AI servers were involved in the alleged operation, split between those that reached Chinese buyers and those that were seized before export.

Prosecutors allege that some defendants created a company registered in Japan to help facilitate the transfers. They are accused of setting up fake websites and falsifying end-user documents to conceal who would ultimately own and operate the servers. Prosecutors identified an Nvidia manager surnamed Chang as a central figure in the alleged scheme. Chang is accused of authorizing the release of the B300 GPUs used in the servers at the heart of the case. Authorities are seeking a five-year prison sentence for him in connection with the exports to mainland China.

Some reports indicate prosecutors are also pursuing maximum five-year sentences for several other defendants, bringing potential multi-year prison terms into focus for multiple people involved.
