Virginia sets 2027 start for retail marijuana

Virginia has enacted budget legislation that establishes a regulated retail market for recreational marijuana, setting July 1, 2027 as the start date for legal sales. Adults aged 21 and older will be able to purchase marijuana from licensed retailers under the new framework. The law is part of the state’s latest budget package, which incorporates detailed rules for how and when the market will launch.

State regulators are directed to open the application process for retail licenses on February 1, 2027. This several‑month window is intended to allow time for reviewing applications, awarding licenses and preparing businesses to open doors by the July 1, 2027 sales start. The staggered schedule creates a clear sequence from regulatory preparation to full consumer access.

The legislation caps the number of cannabis shops at up to 350 across Virginia. This ceiling defines the maximum number of licensed retail outlets that may operate once the market is fully rolled out. By limiting the number of stores, the state sets parameters for how widely recreational marijuana will be available within its borders.

Retail sales will be limited to adults 21 and older, aligning the market with age restrictions used for other regulated substances. This age floor is a central feature of the law’s approach to recreational access, distinguishing legal purchases from underage use, which will remain prohibited.

Alongside creating a retail market, the law raises the personal possession limit for marijuana in Virginia from 1 ounce to 2 ounces. This higher threshold defines how much cannabis adults may legally possess once the new rules take full effect. The change updates existing limits to match the forthcoming retail environment.

The measure also continues to permit people to cultivate a small number of marijuana plants at home. By keeping limited home growing in place, the law maintains an additional avenue for adult access beyond the commercial market. Home cultivation remains subject to existing constraints, which are preserved rather than expanded in this legislation.

Recreational marijuana sales will be subject to an excise tax in addition to existing sales taxes. Legislative budget documents project that the program will generate about $51 million in revenue in its first year. These funds are incorporated into the overall state budget calculations tied to the new market.

The excise tax is a core fiscal element of the policy, ensuring that legal sales contribute directly to state finances. By layering this tax on top of sales tax, the state creates a dedicated revenue stream associated with the emerging recreational marijuana sector.

Provisions enabling retail marijuana sales were folded into the broader state budget bill after a compromise with Governor Spanberger. The governor proposed amendments to the retail framework, and lawmakers subsequently accepted those changes. This agreement cleared the way for the measure to become law as part of the budget package.

The use of the budget process allowed the state to tie the marijuana retail system to concrete fiscal projections and timelines. With the law now on the books, regulators, prospective businesses and consumers have defined milestones leading up to the July 1, 2027 launch of recreational sales.
